The Proceeds of Crime Act, 2002, now deals with the processes deployed to sanitise the proceeds of crime. Before the coming into force of this legislation the behaviour was controlled by the Criminal Justice and Drug Trafficking Acts.
The legislation was aimed at serious criminals trying to clean up their ill gotten gains but is an area where the unwary can be placed under investigation or even prosecuted. This is because all that is necessary for the prosecution to establish is suspicion in the mind of the person dealing with what turns out to be criminal property.
